A state appeals court in Texas ruled that TransCanada Pipeline is a common carrier and hence has the power of eminent domain. (h/t Josh Blackman) More coverage over at Inversecondemnation.com and Southeast Texas Record.
The pipeline in question is related to the Keystone pipeline, but more interesting for me is the legal issues associated with our own legislation governing rights of way and easements for power lines and pipelines. The jurisprudence up here is much more sparse than what the Americans have, which makes for more interesting political dynamics on these issues. The last provincial election in Alberta and the ongoing political saga in Ontario with the green energy fallouts is a testament to that.
